Summary and Background Information:
Commerce City was awarded a federal grant to complete improvements adjacent to the new Colorado Boulevard commuter rail station. The approved project scope included construction of the following facilities on Colorado Boulevard from East 70th Avenue to East 72nd Avenue:
· Curb, gutter, and a five-foot wide (minimum) sidewalk along both sides of the street
· Drainage improvements, including inlets, manholes and RCP piping
· Street lighting spaced at 300 foot intervals on both sides of the street.

The project was slated to begin in 2016 and be open to the public in 2018. The city competitively procured an engineering firm consistent with federal guidelines, selecting Atkins North America from six proposals. The original contract for $292,000 was approved by city council with Resolution 2016-132. The original contract had a termination date of December 1, 2017; the first amendment extended the termination date to November 2018.

In addition, the Denver Regional Council of Government (DRCOG) identified this as one of three delayed TIP project in January 2018, requiring a variance from the Board and an action plan to remain eligible for further federal funding reimbursement. Commerce City must initiate construction on the project no later than October 2018 to avoid further action by the DRCOG board.

A second amendment to the Atkins contract is required to further extend the Atkins termination date to July 2019 and increase the contract amount by $119,000. The latest right of way appraisals show construction to be significantly over the $1,927,000 project budget, requiring further scope reductions that do not impact the approved grant scope of work.
