Summary & Background
The purpose of this Resolution is to authorize the City Manager to negotiate the Third Amendment to the Contract for Design and Preconstruction Activities for the E. 96th Avenue Widening Project.

E. 96th Avenue was identified within the City of Commerce City’s Transportation Plan (2010) as a recommended candidate for highway widening in order to provide capacity improvements. E. 96th Avenue is classified as a minor arterial throughout the study area.

The original contract was approved by City Council (Resolution No. 2022-77) on August 15, 2022 and executed effective November 29, 2022 in the amount of $678,204.04. Two amendments to the contract have been previously executed. The First Amendment was effective July 7, 2023 to add a Feasibility Study for an underpass at either the Landmark Drive or Reunion Parkway intersection in the amount of $43,020,00. The Second Amendment was effective on December 8, 2023 was to add design services to extend the project east of Tower Road to tie in with development plans, complete traffic signal warrant study at Laredo Street, add potholing for utility locations, perform right-of-way services at the Chambers Road intersection, and update the Traffic Study. The Second Amendment totaled $200,971.00.

This Third Amendment will add final design services of the underpass near Reunion Parkway, the completion of a Sound Wall Study throughout the project area, additional potholing and survey work. The total amount of the Third Amendment is $443,123.20.
