A RESOLUTION AUTHORIZING AMENDMENT TO CONTRACT WITH RME LTD. TO INCLUDE 2021 ASPHALT MILL & OVERLAY PROJECT

The purpose of this resolution is to authorize an amendment to the contract with RME LTD. d/b/a Elite Surface Infrastructure, Inc., (“Contractor”) to perform the 2021 Asphalt Mill and Overlay Project within City streets, at a cost of $2,711,308.91.
Summary & Background
Annually, the City puts together a program for asphalt resurfacing on City Streets. The work performed under this contract amendment includes roto-milling old asphalt, replacing the milled areas with new asphalt, and street reconstruction. For the 2021 Pavement Management Program, we are also proposing to perform crack repairs within the north portion of the City. The crack repairs will not be included in this contract and it will be bid out separately. The work to be performed under this contract amendment includes mill & overlay and street reconstruction at locations provided by the Commerce City Public Works Department. The proposed 2021 Pavement Management Program recommendations were shared with City Council on 10 March, 2021. We received one comment that was addressed through the City Manager’s Office.
Elite Surface Infrastructure, Inc. was the low bid for the 2020 Pavement Management Program. The 2020 contract allows us to amend the contract in 2021 to award to Elite Surface Infrastructure, Inc. if we found their work to be satisfactory and it presents a best value to the City. Public Works has reviewed Elite Surface Infrastructure’s unit prices (they went up approximately 3%), which is nominal considering that the cost of oil has increased in 2021. Elite Surface Infrastructure, Inc., performed acceptable work in 2020, and Public Works would recommend amending the existing contract to allow them to perform the 2021 Asphalt Mill and Overlay Project (2020/2021 price sheet comparison attached).
Award of the 2021 Asphalt Mill and Overlay Project based upon the rates proposed by the Contractor is $2,711,308.91. The locations can be found within the 2021 Pavement Management Program Recommendations (presentation attached).

Financial Impact: The cost to the City for this amendment is $2,711,308.91. Financial impact to City staff will be for the management of our contractor.
Funding Source: The pavement management budget and street reconstruction budget.
