Body
The purpose of this resolution is to grant an easement to the South Adams County Water and Sanitation District (SACW&SD) for sanitary sewer or water pipelines through Tract B, Second Creek Farm Filing No. 1 Amendment 1, which is owned by Commerce City. Resolution No. 2021-25 authorizes the Mayor and the City Clerk to grant an easement to SACW&SD, substantially in the form attached, on behalf of the City.

Summary & Background
Second Creek Holdings is in the process of designing a sanitary sewer line to provide service to their future residential development located southwest of Tower Road and 96th Avenue in Commerce City, Colorado. The proposed sewer line will connect to the existing SACW&SD infrastructure located south of Second Creek Farm Filing No. 3. This will require the extension of SACW&SD’s infrastructure through Tract B Second Creek Farm Filing No. 1 Amendment 1, which was previously dedicated to the City in order to get wastewater flows from Second Creek Farm to SACW&SD’s infrastructure. Tract B is zoned for open space and is not within the floodplain. The 118 square foot. easement is needed to connect an existing 30-foot sanitary easement (Second Creek Filing No. 3) with an existing 30-foot SACW&SD sanitary easement (Reception No 2019000071790). Parks, Planning, and Public Works staff has reviewed the location of the proposed easement for the infrastructure and does not foresee any conflicts with the future use of Tract B.
