Summary and Background Information:
Through Ordinance 2300, passed by the City Council on November 16, 2020, Commerce City imposed a temporary restriction of third-party food delivery service fees and other requirements to ensure the survival of the city's restaurants, continued availability of restaurant services for residents, and fairness to consumers and others during the COVID-19 public health emergency. Following the enactment of the restriction, some restaurants in the city have signed up for third-party delivery services. The city has not received complaints of any violations of the ordinance.
The proposed ordinance extends the restriction through July 31, 2021, from its current expiration on March 31, 2021, unless earlier repealed due to an increase in restaurant capacity that permits restaurants to return to full capacity operations. At this time, in-person dining restrictions remain in place.
