Request for Consent of the City Council to a Proposed Inclusion of Land in the Nexus North at DIA Metropolitan District

The Nexus North at DIA Metropolitan District (“District”) has requested the Council's consent to the inclusion of a 12-acre parcel in its boundary. The Council's consent is required by the District's Service Plan, approved in 2019. As described in the written request, the 12-acre parcel is currently in another district (DIATC Metropolitan District) but was recently purchased along with 158 acres already in the District. Development of a building is anticipated to occur across the parcels and the two districts have been asked to accommodate a process to ensure the building is included in only one of the districts. The excluding district has already approved the exclusion and its counsel has represented that the exclusion will not affect the operations ability of that district or its ability to retire existing bonded indebtedness. The District will hold an inclusion hearing following Council's decision. Court approval of the exclusion and inclusion will follow.
