AN ORDINANCE SUPPORTING THE PRACTICE OF MASSAGE THERAPY BY REPEALING AND REENACTING DIVISION 7 OF ARTICLE III OF CHAPTER 9 OF THE COMMERCE CITY REVISED MUNICIPAL CODE RELATING TO THE LICENSING AND REGULATION OF THE OPERATION OF MASSAGE FACILITIES

Summary and Background Information: Council had an opportunity to review a draft of this massage facility ordinance at a study session held on July 8 and was supportive of moving forward. Following the study session presentation, staff met with representatives from two local massage facilities and representatives from massage professional associations to solicit feedback. On October 7 council was presented with a redline version of the ordinance reflecting the feedback provided by city council and the professional association and unanimously approved the ordinance on first reading. Staff recommends amending Section 9-3705 in the ordinance as approved on first reading by replacing subsection (a)(5) with the following, related to disqualification for licensing:
(a)(5) Subject to the requirements of C.R.S. § 24-5-101 et seq., any person who has any prior convictions or pending criminal charges for any crimes involving: prostitution or any other violation of C.R.S. Title 18, Article 7, Parts 2, 4, 5, or 7 as may be amended; sexual assault, sexual exploitation, or human trafficking or any other violation of C.R.S. Title 18, Article 3, Parts 3, 4, or 5, as may be amended; or domestic violence, child abuse, or any other violation of C.R.S. Title 18, Article 6, Parts 4 or 8, as may be amended; or any act that would constitute a violation of a similar law of another jurisdiction.

Recommended Motion: I move to amend Ordinance 2239 by replacing subsection 9-3705(a)(5) with the language proposed by the staff.
