Summary and Background Information:
Commerce City received money from the DIA Noise Settlement in 2006, which has accumulated to $1,778,217.29 today. The Noise Mitigation Plan as approved by the court states that the funds must be used to mitigate the impact of noise caused by the airplanes leaving DIA by the purchase of undeveloped residential property, for open space/recreation use, located within one of the flight paths with a 55 LDN or greater. City staff members have worked on finding land that would meet the criteria set out in the mitigation plan.

The intent is to use all of the DIA Noise Mitigation funds, currently $1,778,217.29, plus $21,782.71 of General Fund money to purchase 48.4 acres of land on the south side of East 88th Avenue located in Filing 1 of the Second Creek Farms subdivision (located west of Tower Road).

The land owners are currently preparing plat amendments that will call out the land to be purchased by the City as Tract C in Filing 1. The budget amendment is necessary to appropriate the money so that the land purchase closing can occur as soon as the land purchase agreement is signed by both parties and the amended plat is approved. The ordinance will also close the DIA Noise Mitigation account.
