Title

RESOLUTION APPROVING THE INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF BRIGHTON REGARDING ANNEXATION BOUNDARY AND PLANNING COOPERATION

Body

Summary and Background Information

The cities of Brighton and Commerce City entered into an intergovernmental agreement (IGA) in 1989 for the purpose of mutually agreeing on the future common boundary between the two cities and to potentially share revenue from development along that common border where it is aligned with East 120th Avenue.  The IGA expires after 30 years on February 7, 2019.  The agreement was successful in establishing a mutually agreed upon border.  No revenue was shared under the agreement.

The Council met in executive session on April 2, 2018 to discuss and to instruct negotiators regarding the IGA proposed to replace the 1989 agreement.

The proposed IGA is attached and recommended for your approval.
