Summary and Background Information: City Council adopted Resolution 2018-37 on May 21, 2018, which approved granting an access easement to the Fairmount Cemetery Company at the time required by the Regional Transportation District (RTD) to comply with the Public Utilities Commission's orders for the completion of the project. The RTD pursued the relocation of the Riverside Cemetery entrance to York Street as part of the North Metro Rail Line Project to eliminate an at-grade vehicle crossing with the new commuter train tracks at Brighton Boulevard. The easement's legal description was not included as part of the resolution's initial adoption and the easement had not been needed in the form granted.
This resolution includes the final legal description for the easement, the negotiated agreement for execution and rescinds Resolution 2018-37. RTD is working with city staff to obtain the necessary permits to begin construction of the new access point, which is required to be open for public use prior to closing the Brighton Road entrance and implementing corridor testing.
