Summary and Background Information: Residents approached city council in 2017 requesting retaining public right of way at 102nd and Olathe (identified as Tract D of the Buckley Ranch Subdivision) for open space. As part of the attached plat, this area was dedicated for a future road connection to 104th Avenue, with the metro district having the responsibility to maintain it until it became used in such a manner.

Staff analyzed the updated current and future conditions of this potential roadway connection, and indicated support to not install a roadway connection in June 2017. The Lutheran High School to the north also was agreeable to this configuration as well. City staff noted the desire to retain the ability to add a trail connection from the parcel to planned trail networks in the future.

The City set a goal to vacate the right of way and complete an intergovernmental agreement with the metro district by the end of 2017. Interim staff re-engaged on this issue, coordinating with the city attorney’s office on the best method to achieve the desired outcome of open space for Buckley Ranch residents.

A property transfer of this parcel to the Metro District for the public good and benefit - while retaining an appropriate section of the current right of way for the future trail connector as noted in the attached map - was determined to be the best legal vehicle. The metro district is supportive of this request.

The Commerce City Charter and Revised Municipal Code have established and adopted procedures by which the city may transfer its interests in real property such as the desired tract, recorded at reception number 20040504000312530 on May 4, 2004, in Adams County, Colorado.

The resolution presented for action tonight authorizes the city manager to complete the property transfer.
