Summary and Background Information: On March 31, 2017, the city clerk received a complete license application packet for a retail marijuana store license and retail marijuana cultivation license. At that time a public hearing on the applications was tentatively set for July 7, 2017. In April of 2017, the applicant's attorney advised us that her client was having second thoughts about continuting with the application process and asked us to discontinue our investigation. In June of 2016, the city was advised once again, by the applicant's attorney, that the applicant wished to proceed. During the hold process, the fingerprints taken by the applicant were rejected. The applicant was refingerprinted on June 6, 2017, and those prints were also rejected. The applicant reported to the Colorado Bureau of Investigation on September 8, 2017, to be electronically fingerprinted and a public hearing date for December 1, 2017, was set. A legal notice was sent to the newspaper for publication in a timely manner; however, it appeared that the premises was not properly posted, by the applicant, for 10 days and the hearing was vacated and reset for January 19, 2018. In the meantime, the state-issued retail licenses terminated on December 2, 2017, and since the applicant has not been licensed by the city yet, those licenses are not renewable.
