RESOLUTION APPROVING INTERGOVERNMENTAL AGREEMENTS BETWEEN THE CITY OF COMMERCE CITY, COLORADO AND THE SOUTH ADAMS COUNTY FIRE PROTECTION DISTRICT AND THE GREATER BRIGHTON FIRE PROTECTION DISTRICT REGARDING THE ASSESSMENT, COLLECTION, AND REMITTANCE OF EMERGENCY SERVICES IMPACT FEES

Summary and Background Information:
To implement the new fire impact fee (Ordinance 2146), the City is required to enter into an intergovernmental agreement with South Adams County Fire Protection District and Greater Brighton Fire Protection District. The intergovernmental agreement was negotiated with the districts after the receipt of instructions from the City Council on July 11, 2017 .
Key terms include:
- Permission for the districts to collect the fee and limitations on collection and expenditure;
- Annual reporting by the districts;
- Provision of a new fee study at least every 7 years;
- 180-day notice and a meet and confer requirement before the City terminates the IGA;
- To the extent allowed by law, the districts will protect the City from legal challenges to the fee.
