Fire Impact Fee Discussion

Summary and Background Information: Council will discuss an amendment (Ordinance 2146) to the Land Development Code to implement a fire and emergency services provider impact fee for new development within two fire protection districts in the City. The Planning Commission recently voted 3-2 to not recommend approval of the fee. The purpose of the study session is to discuss specific provisions of the ordinance before the ordinance is considered on first reading.

Key provisions for discussion include:
1) Exemptions:
a. Should moderate-income housing be exempted, and what should the definition of moderate-income housing be?
b. What areas of the City should not be subject to the fee:
i. The area south of 80th and west of RMANWR? or
ii. The Mile High Greyhound Park and (single family residential structures only) west of Quebec Parkway, east of Colorado Boulevard, north of 56th Avenue, and south of 88th Avenue?
c. Should governmental/quasi-governmental construction be exempted?
2) Amount:
a. What should the amount of the fee be for each class of structure in each district?
b. Uniformity:
i. Should the amount of the fee be the same for each district?
ii. Should the fee for non-residential development in the South Adams County Fire Protection District be divided in the same manner (commercial and industrial) as the recent division proposed by Greater Brighton Fire Protection District?
3) Effective Date: Should the fee be effective:
a. January 1, 2018?
b. Some other date? or
c. Phased in over time?
