RESOLUTION APPROVING CHANGE ORDERS TO CONTRACT FOR HIGHWAY 2 WIDENING PROJECT

Summary and Background Information: The initial construction contract for the Highway 2 Widening Project with Flatiron Constructors was approved on August 22, 2016.  At time of award, it was anticipated that Right of Way (ROW) would be obtained from BNSF. Staff briefed council on potential change orders to Highway 2 and eminent domain actions during a June 26, 2017 special meeting. The city recently received notification of an adverse ruling on this issue; the roadway must be constructed within the City’s existing ROW and the design is currently being modified to accommodate this change. The modifications include retaining walls, drainage pipe headwalls and redesign of drainage bio-swales. To keep the project on schedule and reduce impacts to the traveling public, the design and construction of these modifications are being executed in a phased approach to allow for delivery of solutions to the most critical items first.  The final design and pricing and negotiation of all changes will occur over the next few months.

The intent of this change order authorization is to allow the City Manager to continue to negotiate these changes and approve work packages in the most efficient and timely means possible. Other pending changes included in this authorization include modifications to increase parking in the Derby area and intersection modifications at 72nd and Highway 2.  The total of all changes is expected not to exceed $2,000,000. Available funding has been identified to cover these increased project cost.
