Summary and Background Information:
Based on an unknown outcome and timeframe on being able to obtain BNSF ROW, Commerce City has made the decision to move forward, in parallel with still trying to obtain BNSF ROW, with preparing design alternatives to construct the roadway completely outside of BNSF ROW. Implementing this plan will mitigate a potential construction delay that could result in additional contractor general condition costs. This decision requires additional design and results in the need to amendment HDR’s contract to support this work. Also included in this amendment are costs for the re-design of the Derby area to increase parking as directed by City Council, costs associated with the prolonged condemnation process for both BNSF and V-Co, and additional allowance for design support during construction.
This contract amendment of $399,269 requires council approval.
