AN ORDINANCE AMENDING DIVISION 2 OF ARTICLE II OF CHAPTER 8 OF THE COMMERCE CITY REVISED MUNICIPAL CODE REGARDING THE LICENSURE OF MARIJUANA BUSINESSES TO ESTABLISH DISTANCE REQUIREMENTS FOR THE LICENSING OF RETAIL MARIJUANA STORES AND MEDICAL MARIJUANA CENTERS

Summary and Background Information:
On June 5, the City Council requested that staff prepare a restricting ordinance to establish a 1,000 foot distance requirement between all marijuana stores, retail or medical, with certain exceptions.
The attached draft ordinance restricts acceptance of applications and issuance of licenses for retail and medical stores within 1,000’ of property (measured from the property line) with a licensed premises: (1) for which a license has issued and remains valid; or (2) for which an application has been submitted and deemed complete by the City Clerk until finally disposed.
Exceptions include: (1) renewal applications; (2) pending applications deemed complete as of the effective date of the ordinance; and (3) applications for new licenses of the same type for the same business premises required by certain events like the sale or transfer of a business or change in ownership, financial structure, investors, etc. Co-located adjacent businesses are treated as one premises for this ordinance.
