Retail Marijuana Separation vs Cap Discussion

Summary and Background Information:
Emerging from previous study sessions on the city’s marijuana ordinance, staff has researched the effects of implementing either a separation requirement or cap on the number of retail marijuana establishments in the city.
Staff is requesting feedback from Council on the following potential updates to city code:
1. Establish a separation requirement between retail marijuana stores.
2. A) Establish a cap on the total number of retail marijuana stores in the city, B) Establish a total cap per ward (or other geographic boundary).
3. Establish a combination of both a cap and separation requirement for retail stores.
4. No modification to the existing ordinance.
Currently, the city does not have a separation requirement between marijuana retail stores or a cap on the total number of stores in the city. The current ordinance provides 1,000’ separation between educational institutions, child care facilities, drug rehab facilities, group homes, correctional facilities, or public parks or recreation centers. There is a 500’ separation from properties zoned for residential uses or has residential entitlements.
The presentation will give an update on the current conditions of retail marijuana in the city, show how the current ordinance influences the eligibility of certain properties, demonstrate how other jurisdictions are utilizing cap and/or separation requirements, and provide analysis as to how any proposed changes to the ordinance would impact properties in the city.
