Summary and Background Information

L. G. Everist, Inc. is requesting to remove and/or amend certain conditions that are attached to their existing Conditional Use Permit (CUP). This request would eliminate certain development conditions that have been completed, eliminate the requirement that uses-by-right in the I-3 zone district be approved by City Council, and update language to reflect current standards.

 

In 1991 L.G. Everist, Inc. was approved for a Conditional Use Permit (CUP) to have sand and gravel operations, rock crushing operations, concrete batch plant operations, and asphalt batch plant operations. This approval was granted, subject to 18 conditions. The CUP has been amended three times (1994, 1996, and 1997) and there are currently 21 conditions attached to the CUP.  Most of the existing conditions are development related (landscape installation, screening requirements, paving requirements, etc.) that have been completed and/or are now governed by the Land Development Code. Therefore, the applicant is requesting to amend two of the existing conditions to update the language, remove 13 conditions, and keep six of the existing conditions unchanged. This would result in eight total conditions remaining attached to the CUP.
