Summary and Background Information

At the request of City Council, Community Development presented information in June regarding food cart/truck regulations in the city’s outdoor vendor ordinance.   Council provided direction to staff to make changes improving the regulatory framework for them.  Staff returned to Council in September with recommended changes that have been included in the proposed ordinance along with changes derived from Council input, including:

 

                     Reduce distance to residential properties from 300 to 100 feet measured from the property line.

                     Limit operation within 300 feet of residential properties between 9 p.m. and 7 a.m.

                     Leave distance to schools of 300 feet (during school hours) unchanged.

                     Outdoor vendor structures (including food carts/trucks) must not become permanently “fixed” to the property, or remain overnight without property owner permission,              or for more than three nights 

                     Food carts to display required licenses.

                     Maintain distance of 175 feet to restaurants.

                     Allow food carts/trucks to be closely grouped in areas authorized by city, including express authority to operate near city facilities.

 

Council was receptive to the proposed changes and staff proceeded to ordinance preparation with the City Attorney. Other minor technical modifications to the ordinance have also been made.
