Summary and Background Information:
Community Development staff presented information to council at the April 11th study session on a proposed ordinance change, adding a definition of noxious weeds to Section 6-2012 “Weeds and Vegetation” of the Commerce City Municipal Code. The change means noxious weed violations of Section 6-2012 are subject to violation penalties similar to other nuisance violations. Council reacted favorably to staff’s recommendation and therefore proceeded to draft an ordinance.

As background, below is the staff summary entered for the April 11th Study Session.

In 2015, the city adopted its first ever Noxious Weed Management Ordinance establishing regulations and program management objectives for various noxious weed types throughout the city. The ordinance was adopted in part to comply with state laws regarding management of noxious weeds, but more importantly, to provide a mechanism for the city to appropriately manage noxious weed growths and provide proscribed management methods to ensure their control and eradication. After implementation of the plan it has become clear, in addition to management programs and training established in the management plan, that a clause should be added to Municipal Code Section 6-2012 “Weeds and Vegetation” creating violation penalties intended specifically for violations of noxious weed provisions. Because noxious weeds are different and the program is different than typical nuisance weeds, it has been determined that violation penalties should be added specific to noxious weeds and used when education and weed management programs fail to achieve desired outcomes.
