Title

an ordinance repealing paragraphs b and c of section 8-2317 of the commerce city revised municipal code WHICH contains certain separation requirements for the co-location of marijuana businesses

Body

Summary and Background InformationChapter 8 of the Commerce City Revised Municipal Code governs the licensing of medical and recreational marijuana within the City.  Currently, the City requires that co-located businesses be physically separated from each other and that they maintain separate ventilation systems.  During pre-application meetings, several businesses have expressed their concern with these requirements.  After review and consideration, City staff concluded that the requirements in Chapter 8 were not necessary because public safety is adequately protected by the separation requirements contained in the City’s building code.
