Summary and Background Information:

NOTE: The 2nd Reading ordinance does NOT include the sections concerning electric fences and telecommunications.

The 26 proposed amendments for 2014 can generally be characterized into five categories. The first category focuses on legal clarifications, the second category includes land use table additions, the third category focuses on processes related to improving customer service, the fourth category includes amendments in order to ensure that the LDC stays modern, and the fifth category includes amendments that have been identified either by staff or the community as needed in order to ensure that the LDC continues to meet the needs of the community.

Based on discussion at the January 5, 2015 City Council meeting, the amendment to the telecommunication facilities section of the LDC has been removed. Telecommunication facilities will be addressed in a study session with City Council at a later date.

Additionally, discussion surrounding the update to the City's electric fence standards required further amendments. Staff has made revisions to the electric fence language with regards to setbacks for gates, backup power in case of battery failure, opportunity for screen style perimeter fencing as an alternative to increased setbacks, and maximum height for the electric fence. However, additional information is needed to resolve a conflict with the building code and staff is currently conducting research with the appropriate agencies. Due to this conflict, the electric fence amendment has been removed from Ordinance 2020 and will be heard as a separate item at an upcoming City Council meeting.

Staff will continue to monitor issues that arise in the future and track those issues in order to make necessary changes in the future. Therefore, City Council should expect to see additional amendments in the future in order to ensure that the...
