AN ORDINANCE APPROVING THE SECOND AMENDMENT TO THE DERBY DOWNTOWN DISTRICT PUD ZONE DOCUMENT.

Summary and Background Information:  
The Derby PUD was originally approved in 2007.  This PUD creates a unique zone district for the Derby Downtown District.  The PUD includes the Derby District boundary, a purpose statement, and information about the character of the district, conceptual plans and a land use table that describes allowable uses for those properties within the Derby PUD.  Amendments proposed are minor in nature and have been identified by staff to modernize the PUD zone document or to amend text to ensure the PUD zone document is accurate and up to date.  All of these amendments create additional flexibility.  No property rights are restricted through this amendment.
This PUD has both a master plan and design guidelines that are supplemental to the zoning document.  The proposed amendments are for the PUD zoning document only and do not impacts either of the supplemental documents.  Additionally, these amendments do not affect the mid-century theme in Derby.
Staff has proposed these minor amendments to the Land Development Code based on their ability to implement the City's Comprehensive Plan and positively impact the community. These amendments are intended to better meet the needs of the Derby Downtown District by ensuring that the PUD zone document is clear, consistent, and modern.  
 
Planning Commission voted unanimously on December 2, 2014 to send a recommendation of approval to City Council.
