AN ORDINANCE repealing paragraph (e) and amending paragraph (f) of section 12-5005 of the Commerce city revised municipal code pertaining to restricted and prohibited solicitations

Summary and Background Information:  
Section 12-5005 of the Commerce City Revised Municipal Code regulates solicitations within the City of Commerce City.  Recently, the city was approached by businesses that have been negatively impacted by paragraph (e) of that ordinance which prohibits in-person commercial solicitations in residential areas.  At a study session on October 27, 2014, council discussed the reasons behind that section of the ordinance - protecting the safety and privacy of city residents - and options that would continue to protect citizens while allowing businesses to operate effectively.  It was determined that the best option would be to repeal the section of the ordinance that prohibited in-person commercial solicitations in residential areas but ensure that the safety and privacy of residents would continue to be adequately protected through another paragraph in the ordinance that prohibits all in-person solicitations when "No Trespassing" or "No Solicitation" signs are posted.
