Procurement Policy update and discussion

Summary and Background Information:
• City Council discussed the proposed Procurement Policy on February 27.
• As a result of that discussion, staff replaced the section on ethics with a reference to the Council's Ethics Policy #CP-14 and did additional research regarding preferences.
• The City Attorney's Office found case law indicating serious concerns with adopting preferences without supporting data and analysis.
• One option is to undertake an exhaustive study similar to Denver's 2013 Minority/Women Owned/Disadvantaged Business Enterprise Disparity Study.
• Another option is to collect data on Commerce City's contracting and procurement process.
• And, there is always the do nothing option.
