Summary and Background Information:  
The existing Wendy's restaurant at this location is currently a legal non-conforming use in the I-3 zone district. The quick-service restaurant was originally developed in 1983, and has been in use as such since that time. The existing building underwent a remodel in 2009. At this time, Wendy's intends to demolish the existing building and rebuild a new restaurant in the same location. Non-conforming properties are limited in their ability to expand or alter, and redevelopment is only allowed in compliance with the underlying zone district. The zone change to C-3 will bring the existing use into compliance with the LDC and allow for the proposed reconstruction of the restaurant. If approved, the zone change will give the existing use a conforming status that will stabilize and reinforce the commercial character of the area, and will also allow Wendy's to reinvest in this site and redevelop it as a modern, enhanced, quick-service restaurant.
