A RESOLUTION APPROVING INTERGOVERNMENTAL AGREEMENT WITH ADAMS COUNTY HEALTH DEPARTMENT FOR OVERSIGHT SERVICES AT REPUBLIC SERVICES TOWERS LANDFILL

Summary and Background Information:
Commerce City entered into an Intergovernmental Agreement with Tri-County Health Department in July 2019 for inspection oversight at the Towers Landfill. Landfill inspections can be performed by local and state agencies. However, the state has a limited number of inspectors so the IGA is aimed at increasing the protection of public health by setting forth a set inspection schedule and assigning staff. The Tri-County Health Department is no longer in service as of January 2023, so a new IGA was drafted between Adams County Health Department (ACHD) and Commerce City.
ACHD will conduct 4 full scope site visits and 8 limited scope site visits per year. Each full scope site visit will include the following:
A review of the operating record for the facility including groundwater and landfill gas monitoring records;
A field visit to observe provisions to control storm water runoff from the site;
A field visit to observe provisions for controlling windblown refuse;
Observation of waste placement techniques;
Observation of fugitive dust control techniques;
Monitor for compliance with existing bird control program;
Monitor at site boundary for hazardous air pollutants emissions;
An exit briefing with Allied personnel to discuss concerns that may require immediate attention; and
A phone conversation, e-mail or brief meeting with the City to discuss the findings of the site visits.
Limited scope site visits are intended to address Republic’s operational procedures related to litter control, dust control, bird hazard control, and other daily operations.
