Summary and Background Information

The proposed ordinance amends Section 21-3210 (Building and Sign Permits) of the Land Development Code to allow partial building permit for large (over 250,000 sq. ft.) non-residential projects that would otherwise not be permitted due to: lack of complete plans; or plat/zoning standards (other than uses). The ordinance is intended to apply infrequently and will provide flexibility and help to retain economic development prospects and financing.

The ordinance allows for director approval and allows development to proceed only for foundations of buildings at the builder’s sole risk. If the future approval is not granted, the permit would require the builder to remove all construction. Approval of a phased building permit would only occur after substantial review of the related approval had occur and all other building and safety standards apply.
