AN ORDINANCE APPROVING AND ADOPTING FRANCHISE AGREEMENT BETWEEN THE CITY OF COMMERCE CITY, COLORADO AND PUBLIC SERVICE COMPANY OF COLORADO

Summary and Background Information:
The City's 1986 franchise agreement with Public Service Co (PSCo") will expire upon certification of the results of the November election, at which time the question of whether to grant to PSCo a new franchise will be determined. The 2012 Franchise Agreement will be in effect for 20 years and provides for a 3% franchise fee, maintains the 1% undergrounding fund and, among other provisions, establishes the terms and conditions under which the newly granted franchise will be maintained.
The 1986 franchise agreement between the City and PSCo was set to expire on May 13, 2011, but was extended multiple times to allow the parties to continue negotiating the terms of a new franchise agreement. The new franchise agreement will go into effect upon approval by the voters at the November general election of the grant to PSCo of a new franchise.
