A RESOLUTION AUTHORIZING NEGOTIATIONS, PURCHASE, AND THE EXERCISE OF THE CITY’S POWERS OF EMINENT DOMAIN TO ACQUIRE CERTAIN REAL PROPERTY INTERESTS NECESSARY FOR THE 88TH AVENUE WIDENING PROJECT

Summary and Background Information:
The purpose of this resolution is to authorize the City Attorney to take necessary and appropriate action to acquire good title to the Property Interests needed for the 88th Avenue Widening Capital Investment Program project. The authorized action may include good faith negotiation, acquisition, and, if necessary, filing a petition in condemnation to acquire and obtain immediate possession of the Property Interests. On February 3, 2025, Council will consider a resolution awarding a contract for construction of the 88th Avenue - Segment A Widening Capital Investment Program project. To begin construction on Phase A of the project, the City will need to acquire Property Interests. The City has been negotiating acquisition of Property Interests with various property owners. Once all Property Interests have been acquired, then the City can move forward with construction for the much needed road improvements on 88th Avenue.

Due to the physical constraints of the existing drainage system, the western portion of the project (from I-76 to just west of the O’Brian Canal) was designated as Segment A and design was completed for that segment. The project will widen Segment A to four lanes and add a raised median, turn lanes, and a signal at the entrance to the Mile High Flea Market. In addition, sidewalks will be added to improve multimodal transportation, and landscaping and lighting will also be improved. The drainage system will be installed to support Segment A as well as provide detention and an outfall for future improvements to the eastern segments of the project.
