Summary and Background Information:
The Charter of the City of Commerce City (the “Charter”) was adopted May 5, 1970, by the registered electors of the City of Commerce City and has been amended several times since. In 2019, the state general assembly amended Section 24-6-402 of the Colorado Revised Statutes, finding and declaring that it was the general assembly’s intent for local governments to transition from posting notices of public meetings in physical locations to posting notices on a website, social media account, or other official online presence of the local government to the greatest extent practicable. As such, staff is proposing Council submit to a vote of the registered electors of the City of Commerce City at the regular municipal election to be held on November 7, 2023 to amend the Charter to allow the City to satisfy the legal requirements of providing public notice by publishing said notifications on its public website. The Clerk's office assists with directing the publications of ordinances and notices of public hearings in newspapers.
The City Clerk's Office spends approximately $9,000 a year publishing legal notices in newspapers, so this amendment would provide some cost savings to the City annually.
