Summary & Background

This resolution grants a utility easement to the to the South Adams County Water and Sanitation District (SACWSD). Third Creek West is in the process of designing sanitary facilities to provide services to the future residential and commercial development located east of E-470, south of E. 112th Avenue, and north of E. 104th Avenue.  In order to adequately provide for sanitary facilities for the development known as Third Creek West and to minimize the impact to property owners along Tower Road and ease constructability, the engineers for Third Creek West negotiated with the SACWSD and the City of Commerce City to relocate the 21” PVC main on Commerce City’s property.

 

A previous resolution (Resolution No. 2022-69) was passed by City Council on June 20, 2022.  In the review with SACWSD, there was a request by SACWSD to change the location of the crossing of Third Creek to the east of Tower Road. This requires the developer to cross the road further north. As a result, the easement area was reduced to eliminate some of the parallel easement along Tower Road on City property.
