Resolution Authorizing Inclusion of Property in the South Adams County Water and Sanitation District and Related Actions

The property known as Second Creek Farms is located between 96th Avenue and 88th Avenue west of Tower Road. The property was initially subdivided in 2006, at which time right-of-way and other public property was dedicated to the Commerce City. Based on the legal description used in the plat (excluding property dedicated to Commerce City), the developable land within the property was included in the South Adams County Water and Sanitation District pursuant to the district's rules and regulations, as needed to obtain water and wastewater service.
The property is now being or has been re-platted, with developable land and right-of-way reconfigured in a manner that would result area formerly designated as right-of-way being used for development. This means that certain areas would not be properly included in the district and therefore unable to receive water and wastewater service. The property owner (Second Creek Holdings, LLC) and the district have requested that Commerce City include any city-owned property within the subdivision to ensure that all developable land is properly included in the district.
The resolution authorizes the inclusion and the execution of certain documents needed to comply with the district's rules and regulations, including an inclusion agreement and conveyance of groundwater rights.
