AN ORDINANCE AMENDING SECTION 3-1200 OF THE COMMERCE CITY REVISED MUNICIPAL CODE RELATIVE TO THE AUTHORIZATION OF JURY FEES

Summary and Background Information: Commerce City and state law currently authorize the municipal court to impose certain fees and costs relating to cases before it. The City’s Directory of Fees and Charges establishes the amount of these charges. The municipal court incurs costs to assemble a jury and has assessed the cost of that jury against court defendants in certain cases. This ordinance clarifies the intended fees that may be assessed against defendants related to a jury trial, including a “juror fee” when the defendant is convicted or pleads guilty/nolo contendere after a jury has been summoned or a “jury assembly fee” if the jury has been summoned but the trial is continued or canceled at the defendant’s request.
