Summary and Background Information:  
The applicant is requesting to rezone these parcels to PUD to allow the existing electrical and utility operations to become legal conforming uses. These cases are a direct condition of approval from the Cherokee Natural Gas Line CUP Case.  No new development is planned for either of these parcels.The two parcels of land identified in the condition of the CUP are to be rezoned as Planned Unit Development (PUD). The PUD zoning designation will accommodate the needs of the applicant to continue their existing electrical transmission service and will allow the city additional oversight on these properties.  These parcels represent the final Public Service Company parcels south of 104th Avenue that are currently not annexed into the city.

On May 6, 2014, the planning commission held a public hearing, took testimony, and voted (5-0) to forward the PUD Zoning request to City Council with a favorable recommendation, subject to the findings of fact.
