Proposed South Adams County Fire District Impact Fees

Summary and Background Information:
The Colorado General Assembly passed HB 16-1088 during the 2016 legislative session. This bill authorized local governments to impose impact fees on new development for fire and emergency services, with the consent of the local governments. City Council received presentations from both the Brighton Fire District (4/10) and the South Adams County Fire District (5/22). During the presentation(s) both districts presented a fee study they each had commissioned to determine the maximum allowable fee. Both districts’ requested City Council to enter into an IGA, as required by the statute, for the purposes of initiating the new fee.
Staff has had the opportunity to review the fee studies from both entities and a draft IGA provided by South Adams County Fire Protection District (SACFPD). Staff has also met with and provided feedback to the district’s legal counsel. In addition, staff has added the fire impact fee to the Raftelis study, which was previously completed to assess Commerce City fees in comparison to surrounding communities.
In the event the City Council is inclined to further consider imposing such a fee on new development, staff recommends the City Council adjourn into an executive session to receive legal advice from the City Attorney and instruct negotiators relative to the creation of an IGA for this purpose.
