Summary and Background Information:
The City Attorney's Office and City Clerk's Office have worked on modernizing the City's marijuana regulations after a slate of new regulations were approved by the Colorado Legislature. City Council was given an opportunity to weigh in on allowing new license types and regulations at the April 24, 2023 study session. The specific revisions include increasing the setback for marijuana stores from mixed-use with residential entitlements, residential, or agricultural zones from 500 feet to 2000 feet. A section was added to establish a like to like set back of 2000 feet that did not previously exists. Another section was changed to allow for off-site storage with a permit and to explicitly prohibit marijuana hospitality businesses. The amendments revise marijuana related definitions to the LDC to correspond to state law.
