AN ORDINANCE REZONING FROM C-3 TO R-1 ZONE DISTRICT THE PROPERTY DESCRIBED IN EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF, LOCATED AT 5928 POPLAR STREET, COMMERCE CITY, COLORADO, AND AMENDING THE ZONING MAP OF THE CITY OF COMMERCE CITY, COLORADO TO REFLECT SAID REZONING.

Summary and Background Information:
The subject property is approximately one-third of an acre, and was subdivided and built with a single-family detached home in the early 1950s. It has been used residentially since that time, and was annexed into the city in 1962. The non-conforming residential use of the property limits the ability to expand or add to the existing home, and would not allow for the home to be rebuilt in the event that it is destroyed. The requested R-1 zone district will align the zoning with the Comprehensive Plan, will bring the existing residential use into legal and conforming status, and will add a stabilizing force to the neighborhood.

Recommendation:
On January 7, 2014, the Planning Commission held a public hearing, took testimony, and voted (5-0) to forward the zoning request to City Council with a favorable recommendation, subject to the findings of fact and one advisory, which is as follows:
The applicant and/or property owner may at any time be required by Tri-County Health Department and South Adams County Water and Sanitation District to locate and adequately secure a possible abandoned well and possible septic tank on the property.
Alternative:
One option would be for City Council to approve the request as submitted by the applicant; a second option would be to approve the request subject to conditions; a third option would be for City Council to deny the request.
