AN ORDINANCE amending sections 2-1001 and 2-1003 of the commerce city revised municipal code pertaining to the adoption of election codes and write in candidates.

Summary and Background Information:  The City of Commerce City adopted the Municipal Election Code to govern municipal elections conducted by the City Clerk.  Although the City would like to continue to use the Municipal Election Code for such elections, it contains a section prohibiting cities from splitting general election precincts in the creation of wards.  In redrawing our ward boundaries recently, the City determined it was necessary to split general election precincts in order to comply with more pressing constitutional mandates. As a home rule municipality, the City may elect to adopt the Municipal Election Code in whole or in part.  In order to resolve the current conflict with the Municipal Election Code, the City wishes to amend the adoption of the Municipal Election Code to exclude C.R.S. 31-10-502(a), the provision prohibiting the splitting of general election precincts.
