RESOLUTION APPROVING FIRST AMENDMENT TO INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF COMMERCE CITY AND BRIGHTON SCHOOL DISTRICT 27J REGARDING THE PAYMENT AND EXPENDITURE OF USE TAXES

Summary and Background Information:
The City and School District 27J ("District") entered into an Intergovernmental Agreement ("IGA") dated December 16, 2002 regarding the collection and expenditure of use taxes payable to the City for materials purchased by private contractors under contract with the District where such materials are used in public school construction projects within the City (the "Use Tax Funds"). The purpose of the amendment is to broaden the allowable uses of the funds derived from the use tax paid by contractors building District school facilities. The current IGA restricts the use of the funds to the construction of joint-use recreation facilities. To date no funds have been expended and the account holds approximately $1,075,000.
The amendment of the IGA also better defines the joint Use Tax Committee that is charged with developing recommendations for use of the funds.
