RESOLUTION CONSENTING TO INCLUSION OF PROPERTY IN THE SERVICE AREA OF THE DIATC METROPOLITAN DISTRICT

Summary and Background Information:
The DIATC Metropolitan District would like to include newly zoned PUD land into their overall DIATC Metropolitan District. According to the existing Service Plan, the only way to include additional land is to obtain consent by City Council. The property to be included consists of two parcels, totaling 56 acres located just to the north and west of the existing DIATC development. The rezoning of these parcels, to become a part of the DIATC PUD Zone Document, was just approved by City Council on May 2, 2016. No other changes to the DIATC Service Plan are being proposed.
The original DIATC Service Plan to create the DIATC Metropolitan District was approved by City Council on December 19, 2011. At that time, there was no knowledge that the boundaries of the DIATC development would change over time. The request for consent to inclusion has been reviewed by the City Attorney’s Office and the Community Development Department for any issues related to their respective areas of expertise. After reviewing the Request for Consent to Inclusion, staff is recommending that City Council approve the request.

The Development Review Team (DRT) recommends that City Council approve the Request for Consent to Inclusion for the DIATC Metropolitan District.

3. Deny the request.
