AN ORDINANCE AMENDING SEVERAL SECTIONS OF THE LAND DEVELOPMENT CODE REGARDING SHARED DRIVEWAYS

Summary and Background Information

In the summer of 2015, City Council directed staff to draft a LDC amendment ordinance as it relates to the design of new shared driveways for single-family residential uses within the community. This stemmed from the realization that the city’s code did not currently contain any such regulations, other than the requirement for a shared access easement or agreement. 

 

Over the summer, staff has researched this issue and has tested these setbacks and spacing requirements to ensure that they achieve the goals of creating a shared driveway space that is functional and usable by both parties and allows smoother access in and out of garages.  Staff held a study session with council in the fall of this year to review this draft language.  Council was supportive of the draft language at this study session.  Staff took this amendment to Planning Commission in November and they voted 5-0 to recommend approval.  The following attachment contains the proposed language for this section of the code.

Staff Recommendation

On November 4, 2015, the Planning Commission held a public hearing, took testimony, and voted (5-0) to forward the ordinance request to City Council with a positive recommendation, subject to the findings of fact.
