Title
A RESOLUTION AUTHORIZING A CONTINGENT AGREEMENT WITH CATELLUS CC NOTE, LLC, FOR THE RECONSTRUCTION OF A CITY OWNED POND TO ACCOMMODATE STORM DRAINAGE FROM A PROPOSED SUBDIVISION

Body
The purpose of this resolution is to authorize the City Manager to enter into a contingent agreement with Catellus CC Note, LLC, which is the developer of Turnberry Filing 7, for the redesign, reconstruction and maintenance of a City owned pond located on the Bison Ridge Recreation Center property in support of the development.

The collaboration between the City and Catellus CC Note, LLC by having a shared pond will benefit both parties. The developer ...
