City Council request to determine the appropriateness of a public hearing process pursuant to Land Development Code Sec. 21-3241(4)(d) for Settlers Crossing Filing No. 3 Subdivision Final Plat to create 154 residential lots & 11 tracts for the property located at the northeast corner of E. 96th Ave & Tower Rd, zoned PUD (Planned Unit Development District).

Summary and Background Information

Per Land Development Code Sec. 21-3241(4)(d), the City Council may request a final plat be reviewed through a public hearing process if the request is made before the approval date. Community Development posted the administrative subdivision case #S-782-21, Settlers Crossing Filing No. 3, on December 03, 2021 with an approval date of December 14, 2021.  The subdivision is to plat 14.6 acres into 154 residential lots and 11 tracts for other purposes. Prior to the approval date, Staff received a request that Council vote to determine if a public hearing process will be required for the subdivision case.

 

As this process would lead to a de novo, quasi-judicial hearing, there will be no substantive discussion of the merits of the case, opinions or recommendations, or presentation of facts at this time. If Council elects to approve the public hearing request, the Planning Commission will hear the case, presentation of facts and comments/opinions, and make a recommendation to the City Council for final decision-making.
