Summary and Background Information

The applicant, Ryan Mitchell, is attempting to refinance the home on the subject property, 7010 Fairfax Drive.  The property is currently zoned C-3, a regional commercial zone district.  The applicant is requesting to change the zone district to R-1, a single-family residential zone district to create a legal and conforming property.  The R-1 zone district aligns with the Comprehensive Plan designation of Residential Medium.  The property contains a single-family detached house that was constructed on the property in 1979.

Staff Recommendation

On August 4, 2015, the Planning Commission held a public hearing, took testimony, and voted (5-0) to forward the Conditional Use Permit Renewal request to City Council with a favorable recommendation, subject to the findings of fact and no conditions.

 

Alternative

One option would be for City Council to approve the request as submitted by the applicant; a second option would be to approve the request subject to conditions; a third option would be for City Council to deny the request.
