Summary and Background Information:
Finding sufficiency of petition for AN-235-15 with statutory requirements for contents of annexation petitions and setting the public hearing to determine compliance with statutory requirements and whether additional terms and conditions will be imposed.

The petition is to be considered by City Council for substantial compliance with the petition requirements of the Municipal Annexation Act. The petition was submitted as part of an annexation application that includes, among other things, a PUD zoning application. Staff provided comments to the zoning application in March 2015 but no revised application has been received.

The petition contains specific requests and conditions to City Council’s ability to annex the properties. Petitioners have reserved the right to withdraw the petition on the occurrence of several events. The proposed resolution specifically does not approve or accept any such requests or conditions.

If City Council finds substantial compliance with statutory requirements, a hearing on compliance with statutory requirements will be held. This hearing may result in a resolution that sets forth findings of facts and conclusions and a determination as to terms and conditions that City Council may impose. City Council’s ability to proceed with annexation at that time may depend on the conditions included in the petition and requirements of the City’s Land Development Code.

Staff has identified the following potential issues with the petition:
1. Pursuant to Adams County requirements, the top and bottom borders of the annexation map must be ½ inch. The map will not be accepted for filing by the County until the map is correctly submitted. Staff has identified this issue to petitioners.
