The purpose of this resolution is to transfer ROW along 104th Avenue (aka State Highway 44) from the City to CDOT. Resolution No. 2022-35 authorizes the Mayor, City Clerk, and City Attorney to sign, attest, and approve the Deed on behalf of the City.
Summary & Background
The subdivision plat for the 104th Avenue Commerce Park was recorded on June 2, 2021. As a part of the plat a sliver of land totaling 5,481 square feet along E 104th Avenue was dedicated to Commerce City as ROW. At this location 104th Avenue is State Highway 44. In order for the developer to construct a deceleration/acceleration lane and sidewalk along 104th Avenue, directly east of Joliet Street. This ROW is required to be transferred to CDOT. The owner of the property (Trammel Crow) is currently constructing improvements to their site and needs this property transfer in order to finish the project.
