Summary and Background Information

At the November 7, 2022 Council Meeting, City Council passed a motion directing the City Attorney to draft an ordinance creating a moratorium on the creation of new residential metropolitan districts in the City. In response to that direction, an ordinance accomplishing this goal has been provided. This proposed ordinance creates a moratorium on the processing of applications for new service plans for residential metro districts. Lacking a clear definition of "residential metro district," this ordinance relies on the same definition in the previously considered metro district regulations. As such, a residential metro district would include any metro district where residential purposes comprise 10% or more of the property developed or proposed to be developed. This would effectively allow a new metro district application to be processed that includes a mixed use component that is residential. An alternative would be to eliminate even that 10% allowance and allow only for the processing of new service plan applications if they contain no residential use.
