Summary & Background
The City of Commerce City owns the property at 10100 Havana Street (see Map). The property is approximately 50 acres, split nearly in two as First Creek crosses the site. On the 50 acre site, 2.5 acres are established as First Creek Dog Park while the remaining 47.5 acres is proposed as a future community park site. This 47.5 acre parcel has been leased for farming since 2008.
The City began leasing the 47.5 acres to Murray Farms Inc. January 1, 2008. The lease had an original expiration date of December 31, 2008, but the terms of the lease provided for a year to year renewal, with no expiration date. The lease has been renewed on an annual basis through December 31, 2023.
Staff recommends the continuation of the agreement with Murray Farms, through this newly drafted lease, as the currently unused park site would require mowing and weed management of 47.5 acres by Public Works Parks Operations until the future park site is developed. Murray Farms lease agreement requires the operation of the leased property “in accordance with good husbandry; will do any plowing, seeding, cultivating, and harvesting in a manner that reasonably conserves Lessor’s property, including weed management, soil erosion control.”
